Additional Terms and Conditions – Container Printing Service

These Additional Terms and Conditions (“Printing Terms”) apply specifically to the container printing services provided by Amen Packaging (“we”, “us”, or “the Company”). In the event of any conflict between these Printing Terms and our general Terms and Conditions, these Printing Terms shall prevail with respect to the container printing service only.

 

1.0 Service Description

We provide custom printing services on various types of containers, including but not limited to storage containers, glass, plastic, bottles, jars, and other custom containers. Printing may include logos, branding, artwork, safety markings, identification numbers, or other designs as agreed in writing. 

 

2.0 Customer Responsibilities

2.1 You are solely responsible for providing accurate and complete artwork, designs, specifications, Pantone colors, dimensions, and any other requirements for the printing job (“Customer Content”).  

2.2  Should you provide containers, you must ensure that the containers to be printed are clean, dry, free of grease, dirt, or any surface contaminants that could affect print quality or adhesion. We reserve the right to refuse printing or charge additional fees for surface preparation if the container is not in suitable condition.  

2.3 You warrant that all Customer Content is original or properly licensed, does not infringe any third-party intellectual property rights (including trademarks, copyrights, or patents), and complies with all applicable laws and regulations.

 

3.0 Proofing and Approval Process

3.1 We will provide digital proofs or mock-ups of the proposed printing design based on your supplied artwork.  

3.2 You must review and approve the proof in writing (email is acceptable) before production begins.  

3.3 Once you approve the proof, we are not responsible for any errors, spelling mistakes, color variations, or design issues that were present in the approved proof.  

3.4 Minor color variations between the digital proof and the final printed container are normal and do not constitute a defect.

 

4.0 Printing Specifications and Limitations

4.1 All printing is performed using high-durability industrial-grade inks or specialized container coatings.  

4.2 We do not guarantee exact color matching due to variations in container surface material, texture, age, lighting conditions, and environmental factors.  

4.3 Print durability is affected by weather, UV exposure, salt air, chemicals, abrasion, and handling. While we use durable materials, we do not guarantee a specific lifespan of the print.

 

5.0 Turnaround Times and Delays

5.1 Estimated turnaround times are provided as a guide only and are not guaranteed.  

5.2 Production will not begin until we receive your written proof of approval and any required deposit.  

5.3 We are not liable for delays caused by:  

– Late or incomplete artwork or instructions from you

– Unsuitable container condition

– Force majeure events (including weather, supply chain disruptions, or paint/ material shortages)

 

6.0 Pricing and Payment

6.1 Pricing is based on container size, number of sides to be printed, complexity of design, number of colors, surface preparation required, and quantity.  Final invoicing will be provided based on the terms and conditions established by Amen Packaging’s accounting department. 

6.2 A non-refundable deposit of 50% is required to commence work. The balance is due before delivery or collection of the printed container(s), unless otherwise agreed in writing.  

6.3 Additional charges will apply for:

– Surface flaming, or other preparation, or priming

– Design revisions after proof approval

– Storage of containers beyond the agreed collection period

6.4 We reserve the right to ship and invoice for a quantity of printed goods, which may vary up to ten (10) percent over or under the quantity specified, and the customer agrees to accept delivery and pay for such revised quantity and consider the shipment to be complete. Any defect in quality or delays in delivery shall not affect the balance hereof. 

 

7.0 Intellectual Property

7.1 You grant us a non-exclusive, royalty-free license to use your Customer Content solely for the purpose of providing the printing service.  

7.2 All intellectual property rights in the final printed design remain with you (subject to any third-party rights).  

7.3 We retain ownership of all our pre-existing tools, techniques, templates, and know-how used in the printing process.

 

8.0 Warranty and Liability

8.1 We warrant that the printing work will be carried out with reasonable skill and care and will substantially conform to the approved proof.  

8.2 Amen Packaging warrants to the customer that the printed goods are free from defects in materials and workmanship for a period of thirty (30) days from the date of shipment. If it appears within thirty (30) days from the date of shipment that any printed goods do not meet the warranty specified above, the Customer notifies Amen Packaging promptly, Amen Packaging shall thereupon correct any such defect by repairing any defective printed goods, or at Amen Packaging’s option, by making available at Amen Packaging’s plant replacement printed goods, provided, however, that customer shall pay all transportation charges. Amen Packaging will make no allowance for repairs or alterations to the printed goods made by the customer, unless made with the advance written consent of Amen Packaging. Materials furnished by suppliers to Amen Packaging are warranted by Amen Packaging only to the extent of the original manufacturer’s express warranty to Amen Packaging. 

8.3 We are not liable for:

– Any consequential, indirect, or economic loss (including loss of business, revenue, or goodwill)

– Fading, peeling, chipping, or degradation of the print over time due to environmental exposure

– Any issues arising from the condition of the container before printing

– Ink adhesion on customer-supplied containers. 

8.4 Our total liability under these Printing Terms shall not exceed the total amount paid by you for the specific printing job in question.  

 

9.0 Cancellations and Refunds

9.1 Cancellations after proof approval are subject to a cancellation fee of up to 100% of the total job value, depending on the stage of production.  

9.2 No refunds will be issued for approved proofs that are later deemed unsatisfactory by you.

 

10.0 Governing Law

These Printing Terms are governed by the laws of the State of Colorado, United States, unless superseded in Amen Packaging’s general Terms and Conditions.
